In today’s age, more and more people are conducting their business on the Internet. Whether that “business” is online banking, Pay Pal accounts, bitcoin investments, uploading documents and files to the “cloud,” posting videos on YouTube, or communicating with high school classmates via Facebook. All these accounts and files are “digital” assets.

What happens to those digital assets when a client becomes incapacitated or passes away? Who has access to them? Do you or your firm’s estate planning documents give the fiduciary sufficient powers to deal with these digital assets?

Please join us in exploring this brave new world in the estate planning frontier. We will look at the different types of digital assets, provide suggestions for you to assist your clients in managing their digital assets, and furnish sample clauses for use in your estate planning templates.
